Terms of Service

These Terms of Service ("Terms") govern your access to and use of ThairaAI (thaira.ai), an AI-powered assistant operated by THAIRAHUB TECNOLOGIA DA INFORMAÇÃO LTDA, registered under CNPJ 64.477.587/0001-07, headquartered at Rua Rio Grande do Norte, 1436, Sala 813, Savassi, Belo Horizonte/MG, CEP 30130-138, Brasil ("ThairaAI", "we", "us"). By creating an account or using the service, you agree to these Terms. If you do not agree, do not use the service.
1. The Service
ThairaAI connects to your WhatsApp, Telegram, email (Gmail), and calendar (Google Calendar) to read incoming messages and events and to help you draft replies, schedule, and manage your business communications using a managed AI gateway. Features may be added, changed, or removed over time. Some features require you to connect third-party accounts and to grant the permissions necessary for those features to work.
2. Eligibility and Account
You must be at least 18 years old to use ThairaAI. You agree to provide accurate registration information and to keep it up to date. You may sign in with Google or with an email and password (authentication is provided by Firebase). You are responsible for safeguarding your credentials and for all activity that occurs under your account.
3. Plans, Billing, and Usage Limits
- ThairaAI is offered under subscription plans. Paid plans are billed through Stripe, in Brazilian Reais (R$), on a recurring basis until cancelled.
- Usage is metered and may be capped per plan. When a plan's limit is reached, AI requests may be blocked until the next billing period or until you upgrade.
- Subscriptions renew automatically. You may cancel at any time through the billing portal; cancellation takes effect at the end of the current billing period.
- Except where Brazilian consumer law (Código de Defesa do Consumidor) requires otherwise, fees already paid are non-refundable for partial periods.
4. Acceptable Use
You agree not to use ThairaAI to:
- violate any applicable law or regulation;
- send spam, unsolicited bulk messages, or any communication that recipients have not consented to receive;
- harass, threaten, defraud, or impersonate any person;
- violate the terms of the third-party services you connect, including those of Meta (WhatsApp), Telegram, and Google;
- attempt to bypass usage caps, metering, rate limits, or any security measure;
- reverse engineer, decompile, or attempt to extract the source code of the service, except to the extent permitted by law.
5. Your Content and Connected Accounts
You retain all rights to the messages, emails, calendar events, and other content you provide or that the service accesses on your behalf ("Your Content"). You grant us a limited license to process Your Content solely to operate and provide the service. You represent that you have the right and any required consents to connect the accounts you connect and to allow the service to process the related communications, and that you will obtain any consent required from the people you communicate with. You are solely responsible for the messages the assistant sends on your behalf.
6. AI-Generated Output
Replies and suggestions are generated automatically and may be inaccurate, incomplete, or inappropriate for a given situation. You are responsible for reviewing AI-generated output before relying on or sending it. ThairaAI does not provide legal, medical, financial, or other professional advice.
7. Third-Party Services
The service depends on third parties, including Google, Meta (WhatsApp), Telegram, Stripe, and AI providers accessed through our gateway. Your use of those services is also subject to their own terms. We are not responsible for the availability, acts, or omissions of third-party services, including outages or changes that affect ThairaAI.
7.1 Unofficial WhatsApp Connectivity
WhatsApp integration is provided through an unofficial, open-source WhatsApp API (based on the code-chat-br/whatsapp-api project and the Baileys library). It is not provided by, affiliated with, or endorsed by WhatsApp LLC or Meta Platforms, Inc. Connecting your number through an unofficial client may violate WhatsApp's Terms of Service and could result in your WhatsApp number being temporarily or permanently restricted or banned. You acknowledge and accept this risk, you are solely responsible for ensuring your use complies with WhatsApp's terms, and we are not liable for any restriction, suspension, or ban of your WhatsApp account.
8. Intellectual Property
The service, including its software, design, and trademarks, is owned by THAIRAHUB TECNOLOGIA DA INFORMAÇÃO LTDA and is protected by applicable law. These Terms do not grant you any right to our intellectual property except the limited right to use the service as described here. You retain your rights to Your Content.
9. Privacy
Our handling of personal data is described in our Privacy Policy, which forms part of these Terms.
10. Suspension and Termination
We may suspend or terminate your access if you breach these Terms, if required by law, or to protect the service or other users. You may stop using the service and close your account at any time. Upon termination, your right to use the service ends; sections that by their nature should survive (including intellectual property, disclaimers, limitation of liability, and governing law) will continue to apply.
11. Disclaimers
The service is provided "as is" and "as available", without warranties of any kind to the extent permitted by law. We do not warrant that the service will be uninterrupted, error-free, or secure, or that AI-generated output will be accurate or fit for any particular purpose.
12. Limitation of Liability
To the maximum extent permitted by law, ThairaAI will not be liable for indirect, incidental, or consequential damages. Our aggregate liability arising out of or relating to the service is limited to the amounts you paid us in the 12 months preceding the event giving rise to the claim. Nothing in these Terms limits rights that cannot be limited under the Brazilian Consumer Protection Code (Código de Defesa do Consumidor).
13. Indemnification
You agree to indemnify and hold harmless THAIRAHUB TECNOLOGIA DA INFORMAÇÃO LTDA from claims, damages, and expenses arising out of your use of the service, Your Content, or your breach of these Terms or of applicable law.
14. Changes to the Service and Terms
We may modify the service and these Terms. We will notify you of material changes via the platform or email. Continued use after changes take effect constitutes acceptance of the updated Terms.
15. Governing Law and Forum
These Terms are governed by the laws of Brazil. The forum of the District of Belo Horizonte/MG is elected to resolve any dispute, without prejudice to a consumer's right to bring an action in the forum of their own domicile as guaranteed by the Brazilian Consumer Protection Code.
